BIOGRAPHY

Me David Durand has a diverse educational background (law and chemistry) and legal practice, in which he advises individuals and companies of all sizes, in a variety of legal matters. David makes sure that our clients have the right information to make informed decisions.

David assists our clients in the negotiation and drafting of contracts, including software-as-a-service (SaaS) agreements for the provision of information technology (IT) services, which requires additional knowledge in privacy law and security measures. Considering the increasing multi-jurisdictional flow of personal data, organizations are urged to reflect this new reality through the adaptation of agreements, privacy policies, terms of use (ToS) and site terms and conditions (T&Cs).

In IP matters and as a trademark agent, David participates in the management of IP portfolios and obtains trademark registrations both in Canada and abroad through the firm’s network of international correspondents. He conducts due diligence reviews, in-depth analysis of file histories and provides strategic recommendations to our firm’s clients.

David has also represented clients before different Courts, including the Québec Court of Appeal, the Court of Québec, as well as before the Province of Québec’s administrative tribunals.

Prior to co-founding Durand Morisseau LLP, David worked for prominent IP boutique firms, based in Toronto and Montreal, as well as Montreal based pharmaceutical manufacturer, wherein he gained valuable experience in patent law and litigation, in particular PM(NOC) proceedings and drafting Notices of allegation. David also worked under the tutelage of two Justices of the Québec Superior Court and participated in the drafting the ILO Declaration on Social Justice for a Fair Globalization, which was adopted by the International Labour Conference at its 97th session, Geneva, Switzerland, on June 10th, 2008 (United Nations). David has also collaborated with Professor Me Mistrale Goudreau in the publication of an article entitled “Brevetabilité, traitement médical et ordre public social” (La Revue du Barreau, tome 67, 2007-2008, p. 77-123).

David is a member of the Québec Bar and maintains strong relationships with colleagues, and expanding his international network in Europe.
